of Hutchinson, Kansas, 1988, and any subsequent amendments thereto and provisions of K.S.A. 44-1030 and 1031, as
amended, including subsection (a), paragraphs (1) through (5) inclusively of Section 1030, which reads as follows:
the Contractor shall observe the provisions of the Kansas Act Against Discrimination and shall not discriminate against any
person in the performance of work under the present Contract because of race, religion, color, sex, disability, national origin or
in all solicitations or advertisements for employees, the Contractor shall include the phrase, "Equal Opportunity Employer," or a
similar phrase to be approved by the Commission;
if the Contractor fails to comply with the manner in which the Contractor reports to the Commission in accordance with the
provisions of K.S.A. 44-1031, and amendments thereto, the Contractor shall be deemed to have breached the present Contract
and it may be canceled, terminated or suspended, in whole or in part, by the contracting agency;
if the Contractor is found guilty of a violation of the Kansas Act Against Discrimination under a decision or order of the
Commission which has become final, the Contractor shall be deemed to have breached the present Contract and it may be

provisions will be binding upon such subcontractor or vendor.

2. The undersigned hereby certifies that he has carefully examined the specification and that
he has fully investigated the conditions for furnishing materials in connection with this
quotation request for CONCRETE FOR PUBLIC WORKS MAINTENANCE PROJECTS for
the City of Hutchinson, Kansas and he further certifies that he is familiar with the type of
work involved within the scope of the quotation.
3. It is understood that the above approximate quantities are to be used in comparing bids and
that the supplier will be paid on the basis of his unit bid price only for the actual quantities
delivered. These quantities are based on an estimates previous purchases made in the past.
4. The undersigned hereby declares that the only parties interested in this proposal are named
herein, that this proposal is made without collusion with any other person, firm or
corporation, that no member of the Commission, officer or agent of the City of Hutchinson,
Kansas is directly or indirectly financially interested in this bid.
5. In submitting this bid it is understood that the right to reject any and all bids and to waiver
any irregularities has been reserved by the Owner and that this bid shall be good and may
not be withdrawn for a period of thirty (30) calendar days from the scheduled closing time
for receiving bids.

PUBLIC WORKS MAINTENANCE PROJECTS
GENERAL CONDITIONS FOR FURNISHING CONCRETE
All quantities listed in the bid proposal for the various mixes, are approximate based on previous records, and
are not guaranteed amounts, but are provided for consideration for this bid pricing. All purchases will be
based on actual delivered amounts at the bid prices.
All bid prices will be effective for the year that they are bid for and will not be allowable for change until the
following year bid process.
The bid prices only apply to the mixes as specified herein, and any special mixes not specified herein will be
as per priced at the time of order.
All delivery tickets shall be signed by an employee of the City of Hutchinson and shall include as a minimum:
mix type, quantity ordered, additives - both batch and job site, date, time of order, time of batch, time of
delivery, and price. Individual quality control tests performed at time of batch shall also be indicated on the
ticket (i.e. Slump, air entrainment).
When requested, quantities of less than 1 cubic yard (usually in quantities of 1/4 yard increments), shall be
batched for the City Public Works Division to pick up. Orders picked up at the concrete plant will not be
subject to any delivery charges.
The supplier shall provide to the City of Hutchinson a copy of the mix design on file for each of the mixes
specified herein. The mix design shall indicate compliance with all conditions of the concrete materials
specifications. In addition to the mix design, the supplier shall furnish written certification that all mixes
provided will comply with the designs as provided and the quality control will be maintained to guarantee
such compliance. Failure to meet these requirements will be reason for the City to reject a load at delivery
and repeated failures will be reason to cancel a purchase agreement.
The City of Hutchinson reserves the right to purchase from other suppliers, if the supplier cannot provide
concrete a needed (i.e. Supplier is supplying a specific mix for a large project at the time a City order is
needed; equipment breakdown or failure; etc.)
The City of Hutchinson reserves the right to cancel any purchase agreement if the supplier is repeatedly late
in job site deliveries and or repeatedly short on delivery quantity as compared to ordered quantity. The
supplier shall notify the City Public Works Department when a delivery will be late with an expected time of

admixture, and water; proportioned and mixed to produce a workable mixture suitable for specific conditions
All concrete used in this work shall be air-entrained.
All cement used in this work shall be Type I Portland Cement. Type II cement can be used in lieu of Type I.
All rock must come from a KDOT approved quarry that is on the pre-qualified list of freeze/thaw resistant
coarse aggregate sources for on-grade concrete (PQL 3.4).
A. Portland Cement: Different brands of cement or the same brand of cement from different
mills shall not be mixed during use.
(1) Type I & Type II Portland Cement shall confirm to all the requirements of ASTM C150.
B. Aggregates: The use of pit run, or naturally mixed aggregates will not be permitted. Fine and
coarse aggregates shall be separately furnished and stored. The mixing of different kinds of aggregates from
different sources or alternating batches of different aggregates in one stockpile will not be permitted. In no
case shall aggregates containing lumps of frozen or partially cemented materials be used. Aggregates
proposed for use in the work shall meet the following requirements:
(1) Deleterious Substances - Deleterious substances in aggregates shall not exceed the
following percentages by weight when tested under the designated ASTM method.

No one of the above percentages shall be exceeded when taken separately. In addition, any combinations in
either aggregate type of shale, soft friable pieces, sticks, coal or clay lumps shall not exceed 3.0 percent.
(2) Coarse Aggregate - Coarse Aggregate shall be hard, durable, clean uncoated pieced of
crushed rock or gravel. Coarse aggregate will be well graded within the following limits when tested under
ASTM Standard C 136.

(3) Fine Aggregate - Fine aggregate shall consist of clean, hard, durable, uncoated
siliceous or calcareous particles will graded within the following limits.

The Fineness Modulus (F.M.) of the fine aggregate furnished shall be not less than 2.5 nor more than 3.4
when determined by using a sieve series consisting of the No. 4, 8, 16, 30, 50, and 100 sizes. After
acceptance of a gradation for use in the work the F.M. shall not vary more than +.02.
