NOTICE IS HEREBY GIVEN that proposals will be received no later than 3:00 p.m., local time, on Tuesday October 20 th , 2020 per the RFP instructions.

Proposals must be delivered before the submittal deadline. District will reject all proposals received after the specified deadline.

El Dorado Irrigation District (District), an irrigation special district organized and existing under the California Irrigation District Law (Water Code § 20500, et seq.), hereby gives notice that it is now accepting proposals for RFP P20-0020RD Wastewater Sludge Hauling and Disposal as described in this Request for Proposals (RFP).

Interested vendors may obtain the Contract Documents by visiting https://www.eid.org/doing-business-with-eid/procurement-and-contracts . The Contract will be awarded to the vendor who’s proposal provides the best value to the district, but the District specifically reserves the right, in its sole discretion, to reject any or all proposals, or to waive inconsequential deviations from proposal requirements not involving time, price, or quality of the Work.

ADDENDUM NO. 1
Date October 13th, 2020
This Addendum No. 1 (“Addendum”) as dated above modifies certain Bidding Documents
issued by the El Dorado Irrigation District (“District”) in connection with the District’s
WASTEWATER SLUDGE HAULING AND DISPOSAL RFP NO. P20-020-RD. All capitalized
terms not otherwise defined herein shall have the meanings provided in the Bidding Documents.
There are no other amendments to the Bidding Documents other than expressly contained in this
and any other Addenda issued by the District.
1. Questions received (Q) with answers provided (A) by district are below:
Q: Are extensions mutual?
A: Yes, if pricing terms are not agreeable to both parties the extension will not be executed.
Q: Is the contract terms for up to 3 years of award date or three years from the start of the contract?
A: The length of the contract shall be for a maximum of 3 years from the start of the
contract. Usually the District board of directors approves award of contract and then agreement
documents need to be executed. Projected start date for this agreement is 1-1-2020.
Q: Will the district provide typical analytical for the material generated at each plant that includes
at least the following information:
a. California Title 22 metals and priority pollutants
b. 503 metals
c. Nutrient analysis to determine land application rate
A: YES: The District pulls samples quarterly to maintain permit compliance.
Q: How many tons are anticipated from each plant annually?
A: 4,000 tons from each plant
Q: Will the District certify that the material will meet class b, and if not will the District allow for
alternate pricing for subclass b material?
A: Yes
Q: Will the District provide the most recent analytical information for each plant that includes 503
metals testing and nutrient analysis for the purpose of determining the appropriate application
rate?
A: Yes (see Appendix A – Results for El Dorado Hills and Appendix B – Results for Deer Creek to
this Addendum 1)
Q: Will the District require the yard tractors to be in compliance with California Air Resources
Board regulations?
A: No. It has been determined that our current annual usage at each plant is below state
requirements and CARB regulations will not apply.

Q: Will the District consider striking the highlighted text (below) from the Indemnity provision as it
requires the contractor to pay legal fees. The rationale is that if the contractor is paying the legal
fees it should be allowed to designate the counsel to represent them.
Indemnity/Liability. To the fullest extent permitted by law (including, without limitation, California
Civil Code Section 2782), Vendor shall defend (with legal counsel reasonably acceptable to El
Dorado Irrigation District (“District”)), indemnify and hold harmless District and its officers, agents,
departments, officials, representatives and employees (collectively “Indemnitees”) from and
against any and all claims, loss, cost, damage, injury (including, without limitation, injury to or
death of an employee of Vendor or its sub-vendors), expense and liability of every kind, nature
and description (including, without limitation, incidental and consequential damages, court costs,
attorneys’ fees, litigation expenses and fees of expert vendors and/or expert witnesses incurred
in connection therewith and costs of investigation) that arise from or relate to, directly or indirectly,
in whole or in part, but only to the extent that any of the above are actually caused by, any
negligent or reckless act or omission, or willful misconduct, of Vendor, any sub-vendor, anyone
directly or indirectly employed by them, or anyone that they control (collectively “Liabilities”).
Such obligations to defend, hold harmless and indemnify any Indemnitee shall not apply to the
extent that such Liabilities are caused in whole or in part by the sole negligence, active
negligence, or willful misconduct of any Indemnitee.
A: Please stipulate this as a condition of your proposal. The District will consider all factors when
evaluating the proposals and ultimately make the best value recommendation to our board of
Directors.
