Amendment 0004 dated 9/20/2022 to Solicitation 75A50322Q00019

The purpose of this amendment is to add page numbers and align the numbering on the table of contents of the solicitation. In addition, update D.3,Special Requirements Information, pg. 18.

REMINDER ---- AS NOTED IN THE PREVIOUS AMENDMENT 0003, dated 9/5/2022, THAT THE PRODUCT LIST HAS BEEN UPDATED. PLEASE BE SURE YOU SUBMIT THE CORRECT EXCEL SPREADSHEET WITH THE CORRECT PRODUCT WITH YOUR PROPOSAL. PLEASE REVIEW AMENDMENT 3 FOR THE REVISED ATTACHMENTS.

The following details remain unchanged.

The hour and date specified for receipt to offers is hereby changed as follows: From 2:00 PM EST, 9/23/2022 TO: 2:00 PM EST, 9/30/2022.

The anticipated award date is hereby changed from November 15, 2022, to December 15, 2022. Offers must acknowledge receipt of this amendment prior to the hour and date specified in the solicitation or as amended , by one of the following methods:(a) By completing Items 8 and 15 and returning 1 copy of the amendment;

(b) By acknowledging receipt of this amendment on each copy of the offer submitted ; or

(c) By separate letter or electronic communication which includes a reference to the solicitation and amendment numbers.

The hour and date specified for receipt to offers is hereby changed as follows: From 2:00 PM EST, 8/23/2022 TO: 12:00 PM EST, 9/23/2022.

The anticipated award date is hereby changed from September 30, 2022, to November 15, 2022.

Offers must acknowledge receipt of this amendment prior to the hour and date specified in the solicitation or as amended , by one of the following methods:

AMENDMENT 1-

ADD Q & A FORM

Please submit questions on the attached Q & A Template (Attachment 3)

a. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice.

b. The solicitation number is 75A50322Q00019 and is being issued as a request for proposals.

c. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2022-06 dated 05-26-2022.

d. This acquisition is not a small business set-aside. The North American Industry Classification System (NAICS) code is 325412.

e. The Division of Strategic National Stockpile (DSNS), of the U.S. Department of Health and Human Services (HHS) Office of the Assistant Secretary for Preparedness and Response (ASPR), intends to purchase bulk pharmaceuticals. The Government intends to evaluate offers and award a contract without discussions. However, the Government may, in its sole discretion, elect to conduct discussions if determined to be in the best interest of the Government.

f. Performance is anticipated to begin September 30, 2022. The period of performance is for a period of one year.

g. The provision at FAR 52.212-1, Instructions to Offerors-Commercial Items, applies to this acquisition. The Government intends, but is not obligated, to award multiple contracts. The Government anticipates awarding its entire 12-month pharmaceutical quantity for each pharmaceutical to a single offeror; however, an offeror may be awarded a contract for more than one Pharmaceutical. However, this does not obligate the Government to award a contract for each Pharmaceutical. The Government may accept any item, group of items, or quantity of an offer, unless the offeror qualifies the offer by specific limitations.

h. The provision 52.212-2, Evaluation-Commercial Items, applies to this procurement. Addenda to the provision include evaluation factors, subfactors and evaluation criteria.

i. Offerors shall include a completed copy of FAR 52.212-3, Offeror Representations and Certifications-Commercial Items, with its offer. (Note, if offerors are registered within the System for Award Management (SAM) and certs and reps are up to date, make a statement to that effect in accordance with this clause).

The offeror’s complete proposal (including all information required to be submitted as part of the offeror’s;
