The Defense Energy Support Center intends to solicit and negotiation on an Other than Full and Open competition basis for Transportation Services for DiNitrogen Tetroxide (N2O4) with two sources Jack B. Kelley, Amarillo, TX and Superior Carriers, Oakbrook, IL, under the authority of FAR 6.302-1(a)(2)(iii)(A), Only One or a Limited Number of Responsible Sources Exist and No Other Supplies or Services Will Satisfy Agency Requirements. The Government intends to issue a Requirements contract for Transportation Services which includes Line Haul (tractor & trailer) with Defense Transportation Tracking System (DTTS) satellite tracking and dual drivers for contractor-owned trailers carrying various grades of N2O4, a extremely hazardous material.

Offeror shall provide contractor-owned cargo tank trailers which conform to the engineering documents on file with the Office of Hazardous Materials Exemptions and Approvals (HMEA) as stated in Department of Transportation (DOT) DOT-SP-3121 exemption. To be eligible for consideration, the N2O4 carriers must be registered with the Freight Carrier Registration Program (FCRP) IAW DOD Defense Transportation Regulation (DTR) 4500.9-R; and maintain a rating of satisfactory as assigned by the Federal Motor Carrier Safety Regulations (FMCSR) under Title 49, Code of Federal Regulation (49 CFR). The Contractor shall assume all liability associated with the transportation of N2O4 and must comply with 49 CFR Section 387 Minimum Levels of Financial Responsibility for Motor Carriers. The Government requires Transportation Services for this hazardous N2O4 product in dedicated highly-specialized tanker trucks that meet or exceed the DOT Specification MC338 under the authority of the DOT-SP-3121 exemption. Currently Superior Carriers, Inc and Jack B. Kelley Inc. are the only two qualified carriers that have trailers that meet the DOT Specification MC338; therefore, it is the Government s intent to restrict competition to these two carriers. The Period of Performance will be two years, seven months from 1 October 2008 to April 2011. The offeror shall propose on the total number of estimated quantities stated by the Government. Award will be made to the lowest priced, technically acceptable offeror of these services.

The solicitation will be issued on or about 23 June 2008 and will be posted to the FedBizOpps web page (http://fbo.gov/). If you do not have Internet Access, a hard copy of the solicitation may be requested. Only written, emailed, or faxed copies received directly from the requester will be acceptable.
