ADVERTISEMENT ********************** The Board of Regents of The Texas State University System (herein called the Owner), invites sealed lump sum bids for: GRONDS MAINTENANCE SERVICE, € ANNUAL MAINTENANCE OF LAWNS, SHRUBS, PLANTS, BEDS, AND FLOWER GARDENS. GRASS CUTTING SHALL BE LIMITED TO CARDINAL VILLAGE I, II, III, AND IV ONLY. Lamar University is soliciting bids from interested parties to participate in this Landscape Maintenance Contract that will extend throughout the university grounds, including Cardinal Village I, II, III, IV, and that portion of Martin Luther King Parkway (MLK) bordering the university campus. Bids will be received by the Lamar University Facilities Management Director, in accordance with plans and specifications, and any such addenda as may be issued prior to the date of the bid opening. Sealed bids should be clearly marked with the project name, and be addressed and deliver to: Mr. Arthur H. Callahan, Director, Campus Services Facilities Management Lamar University P. O. Box 10016 Beaumont, Texas 77710 No later than 10:00 A.M. o € clock Monday August 20, 2007, subsequently, bids will be publicly opened and read aloud. The work shall include, without necessarily being limited to: Furnish all labor, materials and equipment required to maintain all planting beds, dormitory lawns, shrubbery beds, jasmine beds, and flower gardens. Prospective bidder may acquire Bid Package for their use in preparation of a bid for this work at no cost. There is no expressed or implied use of these documents for any other purpose than bidding the described work. All rights to use of the documents for this project are retained by Lamar University-Beaumont. The Owner reserves the right to accept any informalities or to reject any or all bids. No bidder may withdraw his bid within 90 days after the actual date of the opening thereof. A Mandatory Pre-bid Conference will be held on Monday August 13, 2007, at 9:00 A.M. o € clock in the Facilities Management/Physical Plant Conference Room, 4301 MLK Parkway, Beaumont, Texas. Attendance at this meeting will be essential to the bid process as a tour of all of the areas will be a part of the pre-bid conference. GROUNDS MAINTENANCE SERVICE SPECIFICATIONS Lamar University is soliciting bids for the maintenance of lawns, shrubs, plants, beds, and flower gardens for the entire campus. Includes all university property located between Cardinal Drive on the south to Lavaca Street on the north, and that portion of MLK Parkway bordering the Lamar University campus. Grass cutting shall be limited to Cardinal Village I, II, III, and IV. Interested participants in providing these services will need to comply with the following criteria and specifications. The contract period shall extend from the date of contract award through August 31, 2008. It is anticipated that the contract will be renewed for two (2) subsequent years (September 1 through August 31) on an annual basis contingent upon the mutual consent of the university and the successful bidder. SCOPE OF WORK This contract is to provide for the following maintenance; 1. Keep all planting areas free of weeds, transient grasses, leaves, and trash. To include all jasmine beds, and the cactus garden adjacent to the ROTC Building. 2. Keep all planting beds mulched as needed to retain moisture and keep out transient seeds. (Mulch provided by the University) 3. Keep all plant materials trimmed and pruned to their natural shape. All pruning of plants and trees shall be accomplished during the appropriate season to prevent damage, unless other wise directed by the Grounds Manger. 4. Keep all crepe myrtles trimmed and pruned to be free of new growth suckers. 5. Maintain a mulch ring around all trees that is free of water chutes and weeds. (Mulch provided by the University) 6. Provide proper fertilization for various plant species. 7. Provide for proper application of weed inhibitors, pesticides, herbicides, and fungicides as required. 8. Keep sidewalks free of weeds growing in expansion joints. 9. Mow, edge, and weed eat grass inside the courtyards, and the perimeters of Cardinal Village I, II, III, and IV, to include parking lots. . 10. Control the use of sprinkler systems for Cardinal Village I, II, III, and IV. Report any malfunctions, or repair needs to the Lamar University Grounds Manager immediately. 11. Replace flowering bedding plants at Cardinal Village I, II, III, and IV twice yearly. Plants shall be supplied by the contactor with grounds manager € s approval. 12. Remove excess dirt and clippings from concrete design of jasmine beds along MLK. 13. Maintain crape myrtle trees on MLK by trimming off suckers at base of tree as needed. 14. Mulch yaupons, roses, and crape myrtle trees on MLK as needed. (Much provided by University) 15. Remove litter from jasmine beds on MLK. 16. Trim jasmine on MLK as needed to maintain growth inside concrete design. In order to provide these services the contractor must comply with the following criteria. 1. The contractor must be licensed in the State of Texas. 2. The contractor must provide workers compensation and liability insurance in accordance with the attached schedule. 3. The contractor must have a person in his direct employment who maintains an ornamental, and pest control applicators license issued by the State of Texas. Care shall be taken not to damage surrounding plants when applying any pesticide, herbicides, or fungicide. All local, state, and federal environment laws shall be strictly followed. Accidents, spills, or contamination of any kind shall be reported to the Lamar Grounds Manager immediately. 4. The contractor will determine the frequency and manpower requirements necessary to maintain the areas identified in the specifications, however, minimal frequency will be weekly from March through October and twice monthly from November through February for the John Gray Center, Plummer Administration Building, the campus Quadrangle, the residence at 710 Iowa, and Cardinal Village I, II, III, and IV, Dinning Hall, and Sheila Umphry Recreational Sports Center. The remainder of the campus shall be serviced two times a month from March through October and once a month from November through February. If this schedule fails to maintain the areas as required, the contractor is to provide additional manpower or increased frequency at no cost to the owner. The contractor must provide a trained and knowledgeable work crew in sufficient numbers necessary to adhere to contract schedule. 5. The contractor shall notify the university grounds manager of their arrival on campus and in which areas they are going to be working. A list of concerns shall be maintained at the grounds manager € s office. The contractor shall visit the office at least once weekly to review the list. The contractor shall make corrections in a reasonable amount of time and report back to the Grounds Manger. 6. The contractor shall report to the university grounds manager on each visit to the campus any need for irrigation of planting beds in which plants are showing signs of stress. 7. The contractor shall report to the university grounds manager any plant materials that are dead and need to be replaced. Plants shall be identified by numbers, size, and common name so that they can be replaced. If plants are properly watered, fertilized, and protected from insect and diseases replacement should be minimal. 8. The contract can be canceled by either party by providing a written notification 30 days in advance of the date of termination. 9. Bid price is to be based upon a monthly amount. Billing shall also be for a monthly service. Initial contract duration is expected to be for 12 months, ending August 31, 2008. INSURANCE REQUIREMENTS Insurance: The Contractor shall not commence work under this Contract until he has obtained all the insurance required hereunder and certificates of such insurance have been filed with and reviewed by the Owner. Acceptance of the insurance certificates by the Owner shall not relieve or decrease the liability of the Contractor. Unless otherwise provided for in Supplementary Conditions, the Contractor shall provide and maintain, until the work covered in this Contract is completed and accepted by the Owner, the minimum insurance coverage that follow, provided that the limits of liability may be met in part by the use of umbrella or excess policies, and further provided that the limits of liability stated below are reduced by 50 percent if the Contract Sum is $25,000 or less: Type of Coverage Limits of Liability 1. Worker's Compensation Statutory 2. Employer's Liability Bodily Injury by accident $500,000 Ea. Accident Bodily Injury by Disease $500,000 Ea. Employee Bodily Injury by Disease $500,000 Policy Limit 3. Comprehensive General $1,000,000 Aggregate Liability $1,000,000 Products/Completed Operations Combined Bodily $1,000,000 Personal & Advertising Liability Injury & Property Damage $1,000,000 Each Occurrence $50,000 Fire Damage $5,000 Medical Expense 4. Comprehensive Automobile Liability $1,000,000 Combined Single Limit 5. Owner's Protective Liability Insurance Policy: The Contractor shall obtain at its expense an Owner's Protective Liability Insurance Policy naming the State of Texas and its employees as named insured, and the Architect/Engineer named as Additional Insured, with the following limits: Bodily Injury $1,000,000 Each Occurrence $1,000,000 Aggregate 6. Builder's Risk Insurance: The Contractor shall obtain at his expense All Risk Property Insurance coverage including workmanship, acceptable to the Owner, in the amount of insurance equal at all times to the insurable value of materials delivered and labor performed. The policy so issued in the name of the Contractor shall also name his Subcontractors and the Owner as additional insured, as their respective interests may appear. The policy shall have endorsements as follow: "This insurance shall be specific as to coverage and not considered as contributing insurance with any permanent insurance maintained on the present premises." 7. Flood insurance when specified in Supplementary Conditions. 8. Umbrella coverage when specified in Supplementary General Conditions: The Contractor may provide the following minimum Coverage Limits, as recommended by the advise and counsel of the Contractor's insurance provider: a. When Contract Amount equals less than $5,000,000. Excess or Umbrella Policy of $1,000,000. b. When Contract amount exceeds $5,000,000. Excess or Umbrella Policy of $5,000,000. 9. When applicable, the Contractor shall provide insurance coverage as specified in Supplementary General Conditions for Asbestos Abatement Work and or Demolition Contracts or Work. 10. Worker's Compensation Insurance Coverage. a. Definitions: Certificate of coverage ("certificate") - A copy of a certificate of insurance, a certificate of authority to self-insure issued by the commission, or a coverage agreement (TWCC-81, TWCC-82, TWCC-83, or TWCC-84), showing statutory workers' compensation insurance coverage for the person's or entity's employees providing services on a project, for the duration of the project. Duration of the project - includes the time from the beginning of the work on the project until the contractor's/person's work on the project has been completed and accepted by the governmental entity. Persons providing services on the project ("subcontractor" in 406.096) - includes all persons or entities performing all or part of the services the contractor has undertaken to perform on the project, regardless of whether that person contracted directly with the contractor and regardless of whether that person has employees. This includes, without limitation, independent contractors, subcontractors, leasing companies, motor carriers, owner-operators, employees of any such entity, or employees of any entity which furnishes persons to provide services on the project. "Services" include, without limitation, providing, hauling, or delivering equipment or materials, or providing labor, transportation, or other service related to a project. "Services" does not include activities unrelated to the project, such as food/beverage vendors, office supply deliveries, and delivery of portable toilets. b. The contractor shall provide coverage, based on proper reporting of classification codes and payroll amounts and filing of any coverage agreements, which meets the statutory requirements of Texas Labor Code, section 401.011(44) for all employees of the contractor providing services on the project, for the duration of the project. c. The Contractor must provide a certificate of coverage to the governmental entity prior to being awarded the contract. d. If the coverage period shown on the contractor's current certificate of coverage ends during the duration of the project, the contractor must, prior to the end of the coverage period, file a new certificate of coverage with the governmental entity showing that coverage has been extended. e. The contractor shall obtain from each person providing services on the project, and provide to the governmental entity: (1) a certificate of coverage, prior to that person beginning work on the project, so the governmental entity will have on file certificates of coverage showing coverage for all persons providing services on the project; and (2) no later than seven days after receipt by the contractor, a new certificate of coverage showing extension of coverage, if the coverage period shown on the current certificate of coverage ends during the duration of the project. f. The contractor shall retain all required certificates of coverage for the duration of the project and for one year thereafter. g. The contractor shall notify the governmental entity in writing by certified mail or personal delivery, within 10 days after the contractor knew or should have known, of any change that materially affects the provision of coverage of any person providing services on the project. h. The contractor shall post on each project site a notice, in the text, form and manner prescribed by the Texas Workers' Compensation Commission, informing all persons providing services on the project that they are required to be covered, and stating how a person may verify coverage and report lack of coverage. i. The contractor shall contractually require each person with whom it contracts to provide services on a project, to: (1) provide coverage, based on proper reporting of classification codes and payroll amounts and filing of any coverage agreements, which meets the statutory requirements of Texas Labor Code, Section 401.011(44) for all of its employees providing services on the project, for the duration of the project; (2) provide to the contractor, prior to that person beginning work on the project, a certificate of coverage showing that coverage is being provided for all employees of the person providing services on the project, for the duration of the project; (3) provide the contractor, prior to the end of the coverage period, a new certificate of coverage showing extension of coverage, if the coverage period shown on the current certificate of coverage ends during the duration of the project; (4) obtain from each other person with whom it contracts, and provide to the contractor: (a) A certificate of coverage, prior to the other person beginning work on the project; and (b) A new certificate of coverage showing extension of coverage, prior to the end of the coverage period, if the coverage period shown on the current certificate of coverage ends during the duration of the project; (5) retain all required certificates of coverage on file for the duration of the project and for one year thereafter; (6) notify the governmental entity in writing by certified mail or personal delivery, within 10 days after the person knew or should have known, of any change that materially affects the provision of coverage of any person providing services on the project; and (7) contractually require each person with whom it contracts, to perform as required by paragraphs (1) - (7), with the certificates of coverage to be provided to the person for whom they are providing services. j. By signing this contract or providing or causing to be provided a certificate of coverage, the contractor is representing to the governmental entity that all employees of the contractor who will provide services on the project will be covered by workers' compensation coverage for the duration of the project, that the coverage will be based on proper reporting of classification codes and payroll amounts, and that all coverage agreements will be filed with the appropriate insurance carrier, or, in the case of a self-insured, with the commission's Division of Self-Insurance Regulation. Providing false or misleading information may subject the contractor to administrative penalties, criminal penalties, civil penalties, or other civil actions. k. The contractor's failure to comply with any of these provisions is a breach of contract by the contractor which entitles the governmental entity to declare the contract void if the contractor does not remedy the breach within ten days after receipt of notice of breach from the governmental entity. Each required insurance policy shall expressly provide that it may not be canceled for any reason without 30 days notice to the Owner. The above insurance requirements are not intended to be compounded with the Contractor's standing insurance policies. If the Contractor already has in force insurance policies which provide the required coverage, there is no need to purchase duplicate coverage for this project. Prior to starting work, the Contractor shall furnish to the Owner complete copies of each insurance policy (i.e., insuring agreements, conditions, exclusions, declarations and endorsements) pertaining to the Work.
