Synopsis:

The Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), National Weather Service (NWS), Telecommunication Operations Center (TOC) intends to negotiate on a sole source basis, under authority of Federal Acquisition Regulation (FAR) Subpart 6.302 Other Than Full and Open Competition. A simplified purchase order will be awarded to Sybase, Inc for software licenses for the Sybase Adaptive Server Enterprise that is required usage in the National Weather Service Telecommunications Gateway (NWSTG). The NWSTG is a vital link in the national and global infrastructure that collects and distributes weather data. The NWSTG operates in real-time and ensures the NWS provides weather and flood warnings, public forecasts, and advisories for the entire United States, its territories, adjacent waters and ocean areas. Any outage of the NWSTG could result in loss of life or property and adversely affect the national security and economy. Sybase, Inc. is the sole manufacturer and provider of Sybase products and support services. As a result, the Sybase Adaptive Server Enterprise is available exclusively from the Sybase GSA Schedule. The technical support services, Hotline Support and product updates, are available by Sybase only. Sybase is the exclusive distributor of Sybase logo licenses and provider of support services. The period of performance is for one year from the date of award. This is not a request for competitive proposals. However, interested companies may submit an affirmative response to the requirement within 15 days from the posting date of this notice to Brian.J.Brown@noaa.gov or fax to 301-713-1024. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. No telephone requests will be honored. Award will be made under commercial simplified acquisition procedures, FAR Subpart 13.
