NOTICE TO PROVIDERS OF PROFESSIONAL SERVICES
The State of Hawaii, Department of
Accounting and General Services (DAGS), Public Works Division (DPW) is seeking qualified firms
to provide professional services for Construction
Contract Claims and Dispute Consultant
PROFESSIONAL QUALIFICATIONS
The consultant shall have the following experience
and areas of expertise:
Claim
Preparation, Analysis, and Response
CPM Schedule
Analysis to Quantify Delay, Time Extension, and Extended Home Office
Entitlement
Quantification
of Damages including Delay and Loss of Productivity
Expert Reports
and Testimony in Mediation, Arbitration, and Litigation
Graphics and
Multimedia Presentations
Defective Plans
and Specifications Analysis
Differing Site
Conditions Analysis
Change
Order/Claims Evaluations, Preparation, and Negotiations
Discovery and
Deposition Assistance
SUBMITTAL
REQUIREMENTS
Consultants interested in providing
professional services must submit the following items to the State Comptroller,
DAGS, c/o the Public Works Administrator, Kalanimoku Building, Room 426, 1151 Punchbowl Street, Honolulu, Hawaii 96813 by February
4, 2008, 4:30
p.m.:
1.
Completed DPW
Form 120 (Revised 6/99) (original + 1 copy). DAGS will accept the Federal
Standard Form 330 in place of the DPW Form 120.
2.
Statement of
qualifications (SOQ) for the projects, highlighting the firm s qualifications,
expertise and experience (original + 1 copy). Include information on the
proposed staff to be assigned to the projects and address the criteria listed
in the Selection Criteria below.
3.
The names and
phone numbers of up to five clients who may be contacted including at least two
for whom services were rendered during the preceding year.
4.
Statement
indicating any conflicts of interest in performing services for DAGS and/or the
State of Hawaii. List membership
on State boards, commissions, etc. For more
information, please refer to the State Ethics Code, Chapter 84, Hawaii Revised
Statutes, or contact the Hawaii State Ethics Commission at (808)587-0460 or go

5.
Statement
indicating any objections to retaining specialty subconsultants (i.e., architects,
engineers, etc.) under the prime contract.
Objections may affect a firm s consideration
for certain projects. Note that it is
typically DAGS intent to hire all subconsultants under the prime consultant s
contract.
6.
Any relevant
information on the firm s experience, expertise and past performance including
but not limited to quality of work, cost control and ability to meet schedules
may be submitted.

in MS Word, WordPerfect or Adobe PDF.
Incomplete Submittals: Submittals received by the due date but with
missing or deficient items that are not corrected by the due date will be
considered non-responsive to this notice.
Late Submittals: Submittals received after the above due date will
be considered non-responsive to this notice.
SELECTION CRITERIA
Selection of professionals will be made in
accordance with Section 103D-304, Hawaii Revised Statutes, and Section 3-122-Subchapter
7, Hawaii Administrative Rules, as amended. The selection criteria employed in
descending order of importance shall be:
1.
Experience and
professional qualifications relevant to the project type. Include any information on prime consultant
firm s Hawaii experience and presence since local site and government
issues are considered unique.
2.
Past
performance on projects of similar scope for public agencies or private
industry. Include any information on Hawaii projects. Indicate
the number of projects of this type in the last five (5) years in Hawaii or mainland United States.
3.
Capacity to
accomplish the work in the required time. Include any information on Hawaii projects.
4.
Other criteria
as determined by the selection committee to be relevant or necessary. These include response time(s) to State
Agency inquiries or requests, field assessments, project meeting
accommodations, etc.
a. Indicate timely and cost effective process to accomplish
the work, including ability to service the State on a day-to-day basis and ability
to work with other governmental agencies and interested parties on a daily
basis.
b. Indicate whether or not the firm has an office in
the State of Hawaii or affiliation with another firm having a Hawaii office. If
not, explain how your firm will conduct business with DAGS during normal Hawaii State business hours of 7:45 a.m. to 4:30 p.m. HST.

Campaign contributions by State and County Contractors: Contractors are hereby notified of the
applicability of Section 11-205.5, HRS, which states that campaign
contributions are prohibited from specified State or county government
contractors during the term of the contract if the contractors are paid with
funds appropriated by a legislative body.

whole or part, and to waive any defects in said application in the best
