The Department of Homeland Security (DHS), Office of Procurement Operations (OPO), Protection and Health Affairs Acquisition Division (PHAAD) intends to negotiate on a sole source basis with the National Academy of Sciences (NAS) to conduct a Risk Analysis Study to Evaluate the Effectiveness of DHS Strategies for Risk Modeling and Analysis. This is not a request for a proposal. A solicitation will not be issued and proposals will not be requested.
The National Academy of Sciences (NAS) 500 Fifth Street, NW, Washington, DC 20001 is the specified source that has been authorized by statute to provide these services. Congress, as part of fiscal year 2008 appropriation statute appropriated funds to the DHS, Office of Risk Management and Analysis to enter into a contract with NAS to review the Department s approach to measuring risk, as discussed in the House report , specifically House Report 110-161. Executive Order 12832 authorized DHS to procure services from NAS on a non-competitive basis because of its unique qualifications to investigate, examine, or experiment upon any subject of science or art of significance to an executive agency and to report those matters to the Congress or any other agency of the Federal Government.
Proposed study includes: (1) evaluating the quality of the DHS current approach to measuring risk, through review of a sample of models and methods; (2) assessing the capability of DHS risk analysis methods to appropriately represent and analyze risks from across the Department s spectrum of activities and responsibilities; (3) assessing the capability of DHS risk analysis methods to support DHS decision-making; (4) reviewing the feasibility of creating integrated risk analyses that covers the entire DHS program areas, including both terrorist threats and natural disasters; (5) making recommendations for best practices, including outreach and communications; (6) providing recommendations on how DHS can improve its risk analyses and (7) how those analyses can be validated.
It is anticipated that the proposed period of performance for the risk analysis study will require fifteen (15) months for completion.
The statutory authority permitting other than full and open competition is 41 U.S.C. 253(c)(5) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-5 entitled Authorized or required by statute. Executive Order 12832 authorizes procurement of services from NAS on a noncompetitive basis when a department or agency of the executive branch of the Government determines that NAS, because of its unique qualifications, can provide the measure of expertise, independence, objectivity, and audience acceptance necessary to meet the department s or agency s program requirements.
Therefore, based on the aforementioned facts and the statutory authority at FAR 6.302-5, the Government intends on make a single non-competitive award to the NAS after July 31, 2008.
