Description
The Department of Health and Human Services (DHHS) intends to negotiate with CPD Industries, a small, minority owned business, on a sole source basis, to provide a variety of pelican cases with custom foam interior. The basis for restricting competition is the authority of 41 U.S.C. 253(c)(1) as implemented by the FAR Part 6.302-1 because only one source is available to provide the service in a manner that will satisfy agency requirements.
The Office of Assistant Secretary for Preparedness and Response (ASPR) requires these pelican cases with custom foam interior for storage of radios, radio chargers, laser printer kits and laptop kits used by Incident Response Coordination Teams (IRCT).
CPD Industries can be considered the only responsible source due to their unique capabilities to provide these cases. As part of the program to package deployable equipment, in shippable, man-portable containers, ITEC procured these same types of cases from CPD Industries in 2007 to store portable radios and the charging units. The CPD Industries foam design is copyrighted and specifically engineered for field use.
The purpose of this synopsis is to determine whether there may be other sources with the necessary expertise and qualifications to provide the items described above. Any source capable of providing these items should submit a statement of capabilities with documentation supporting its ability to meet the Governments requirement as articulated above. Any interested source, in order to meet ASPR requirements will need to demonstrate and address in their capability statement (1) that they can provide an equal copyrighted product. No solicitation document is available. Capability statements should be submitted electronically by 5 pm March 31, 2008 to the point of contact listed in this announcement.
