US Customs and Border Protection (CBP) intends to negotiate, on a sole source basis, under authority of FAR 13.106-1(b)(1), with Metron-Athene, Inc. of Woodland Hills, California for 30 Athene Linux Software Licenses. Metron-Athene, Inc. owns all rights to the Athene Linux Software Licenses is the only authorized Provider for installation, maintenance, and support services

***Sole Source determination is based on the need for the Athene Linux Software Licenses to maintain absolute compatibility with CBP s existing Athene Software Suite and licenses for mission critical performance monitoring and capacity planning for servers within CBP s National Data Center.

***Delivery shall be FOB Destination, Washington, DC, and is required within 15 days after receipt of order.

***The North American Industry Classification System (NAICS) code for this acquisition is 511210, and the size standard is 23 million dollars.

**The Government intends to solicit and negotiate directly with Metron-Athene, Inc. No solicitation package will be issued. This notice of intent is not a request for competitive proposals. However, if any interested party believes it can meet the above requirement, it may submit a statement of capabilities. The statement of capabilities must be submitted in writing and must contain material in sufficient detail to allow the Government to determine if the party can perform the requirement. A determination to compete this action based on the responses received is in the sole discretion of the Government. All interested parties must express their interest and capabilities in writing via email. Documents over 10 pages total will not be accepted. No faxed documents will be accepted. Verifications of receipt of responses are the sole responsibility of the contractor. If no responsive statements are received by April 18 at 3:00 pm EST, an award will be made to Metron-Athene, Inc.
