Synopsis:

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Solicitation number VA-246-08-RQ-0271 is issued as a request for quotation (RFQ). This solicitation and incorporated provisions & clauses are those in effect through Federal Acquisition Circular 2005-26. The proposed action is unrestricted and the North American Industry Classification System (NAICS) number is 339112 with an associated business size standard is 500 employees. The contract line items are: 0001 ForceTriad Energy Platform (Mfr Part Nbr - FORCETRIAD) 6 each; 0002 Force Triad Mounting Cart (Mfr Part Nbr - FT900) 6 each; 0003 GEM Bipolar Footswitch (Mfr Part Nbr - E6019) 6 each; 0004 Ligasure Single Footswitch (Mfr Part Nbr - LS0300) 6 each; 0005 Ligasure Single Pedal Footswitch (Mfr Part Nbr - LS0500) 6 each; 0006 Standard Footswitch (Mfr Part Nbr - E6008) 6 each. The manufacturer of these products is Valley Lab. This is a BRAND NAME OR EQUAL requirement. "Or equal" offers must include a full product description in sufficient technical detail to allow the Government to determine the item to be at least equal to the brand name item listed above. The place of delivery is Hunter Holmes McGuire VA Medical Center, 1201 Broad Rock Blvd, Richmond, VA 23249-0002 and the FOB point is destination. Offerors must comply with all instructions contained in provision 52.212-1, Instructions to Offerors-Commercial, applies to this acquisition. The following additional provisions and clauses apply: 52.212-2, Evaluation-Commercial Item, the Government will award a contract resulting from this solicitation to the responsible offerors whose offer conforming to the solicitation will be most advantageous to the government, price and other factors considered. The following factors shall be used to evaluate offers: 1) Technically acceptable; and 2) Price. Technically acceptable is more important than price. Technically acceptable will be evaluated based on the function and operation of the item. Offerors shall submit descriptive literature, product samples, technical features, and warranty provisions. Price will be evaluated to determine its fairness, completeness, and reasonableness as it relates to the items offered. FAR 52.212-3, Offeror Representations and Certifications -- Commercial Items - offerors shall complete only paragraph (l) of this provision if the offeror has completed the annual representations and certificates electronically at http://orca.bpn.gov. If an offeror has not completed the annual representations and certifications electronically at the ORCA website, the offeror shall complete only paragraphs (b) through (k) of this provision; FAR 52.212-4, Contract Terms and Conditions -- Commercial Items; FAR 52.212-5, Contract Terms and Conditions Required To Implement Statutes Or Executive Orders -- Commercial Items - to include items within the clause: 5,15,16,17,18,19,21,24,29(alt I) and 36. The following additional clauses apply: FAR 52.204-7, Central Contractor Registration - offerors must be registered in CCR to be considered for award; VAAR 852.203-70, Commercial Advertising; VAAR 852.273-70, Late offers and VAAR 852.273-74, Award without Exchanges.
