Description and Specifications:
The purpose of this request is to increase the FY2008 SODC consultation contract with Pennhurst Group LLC (44A7001180), by $60,950. This would increase their current FY2008 contract from $452,947 to $513,897. The $60,950 is the amount that Pennhurst Group, LLC lapsed during FY2007. During FY2007, Pennhurst Group LLC lapsed money because their contract was supposed to have started in November 2006, but did not actually begin until May 2007. Therefore, the Division of DD agreed to add the lapsed funds to the FY2008 contract, and have Pennhurst perform the work that was supposed to be done in FY07, in FY08.

Pennhurst Group LLC was chosen via a RFP process in FY2007 to conduct evaluations at each of the State-operated developmental centers in Illinois. The original RFP value for this contract was approved for $621,142. The FY2007 spending was only $107,245 and we therefore request to amend the FY2008 contract by $60,950 for the total value of the contract to equal the original agreed upon amount of $621,142.

Sole Source Only Justification:This relates to a change in an existing contract and is reasonable in scope and cost in relation to the original contract and necessary to complete the contract. The original contract was done via a RFP. The original contract included a total price for FY07 and FY08. Due to a late start in FY07, the vendor did not complete all of the work originally planned for FY07. Therefore the FY07 contract was reduced. This FY08 contract increase is to bring the FY08 allocation up to the total value of the contract originally agreed to in the RFP.

In 2006, the Pennhurst Group was selected via a Request for Proposal Process (RFP) to conduct an evaluation of the State-Operated Developmental Centers in Illinois. To conclude the evaluation, Pennhurst will produce a report for the Administration regarding the current and future operations of the Centers.

Since the original contract for FY07 was not started until late in the fiscal year the total amount allocated to FY07 was not spent. So it was agreed with the provider to allocate the unspent amount and hours from FY07 to the FY08 allocation.

Since May of 2007, Pennhurst has been on-site at the SODCs evaluating operations and/or management services. Pennhurst now has the knowledge and experience with the SODCs to efficiently complete the evaluation process. Installing a different contractor at this time would result in a waste of the resources already invested with the current contractor to be in a position to effectively move forward. Additional time and resources would be needed to bring a new contractor to the point that Pennhurst is in now.

While this particular contract increase is not being issued under a Request for Proposal Process, the vendor itself was originally selected by the Agency for the original contract that is being increased for FY08.

The original contract included a total for the two years and due to a late start in FY07, we are just requesting an increase in FY08 to the original total for the two-year contract.

The current annual budget to operate the nine SODC's is over $300 million dollars. The Department receives over $150 million in FFP annually for the services it provided to persons served in the SODC's.

Over the past several years, various SODC facilities were reported out of compliance with at least one of the eight conditions of participation 31 times, and one facility, the Howe Developmental Center has been decertified.

GOMB is supportive of this effort to review comprehensively SODC management and operations to better ensure that there is no further interruption in Federal Medicaid funding
