Bids

The City of Boston Public Schools (the City), acting by and through its Director of Facilities Management/Senior Structural Engineer (the Awarding Authority), invites sealed bids for the above-entitled project, subject to all applicable provisions of law including, without limitation, sections 39F and 39K through 39P of chapter 30, and sections 29 and 44A to 44J, inclusive of chapter 149 of the General Laws, as amended, and in accordance with the terms and provisions of the contract documents entitled: € F. D. Roosevelt School Renovation and Addition A LEED Registered Project € at an estimated cost of $5,900,000.00.

SCOPE OF WORK:

Temporary conditions, selected demolition, excavation, site work, play structure, fencing, concrete, unit masonry, masonry restoration, metals, rough and finish carpentry, roofing, waterproofing, sealants, doors, frames, hardware, glazing, windows, gypsum board systems, plastering, painting, resilient flooring, resinous flooring, carpeting, toilet partitions, toilet accessories, lockers, visual display boards, signage, laboratory equipment, furnishings, conveying systems, plumbing, fire protection sprinklers, HVAC, fire alarm, electrical and all related work in accordance with the plans and specifications.

PLANS AND SPECIFICATIONS:

Will be available on or about Wednesday, April 9, 2008, at the Office of Facilities Management, 26 Court Street, 2nd floor, Boston, MA 02108, to all interested parties for a deposit of $150.00.

Plans and specifications must be returned in good condition within thirty days after bid opening in order to have the $150.00 returned.

SPECIAL NOTICE:

PRE-BID WALK-THRU WILL BE HELD ON TUESDAY, APRIL 22, 2008, AT 9:00 A.M. TO 1:00 P.M. FOR ALL TRADES AT THE F.D. ROOSEVELT SCHOOL, 95 NEEDHAM ROAD, HYDE PARK, MA

FILED SUB-BIDS:

For a sub-trade designated in Item 2 of the form for general bids shall be submitted to the Awarding Authority, 2nd floor, 26 Court Street, Boston, MA 02108 before twelve o € clock noon (Boston time) on Friday, April 25, 2008, at which time and place they will be valid only when accompanied by (1) Certificate of Eligibility issued by DCAM showing that the contractor has been approved to bid on sub-trades the nature of those in this advertisement, and (2) a Sub-Bidder Update Statement summarizing the contractor € s record for the period between the latest DCAM certification and the date the contractor submits its bid.

SUB-BIDS: MASONRY, ROOFING, WINDOWS, ELECTRICAL, RESINOUS FLOORING, RESILIENT FLOORING, ACOUSTICAL CEILINGS, CONVEYING SYSTEMS, FIRE PROTECTION SPRINKLERS, PAINTING, PLUMBING AND HVAC.

Each sub-bid must be accompanied by a bid deposit in the form of a certified check drawn on, or a treasurer € s or cashier € s check issued by a responsible bank or trust company, payable to the City of Boston, or a bid bond of a surety company qualified to do business in Massachusetts and satisfactory in form to the Awarding Authority.

The amount of such check and penal sum of such bond shall be a sum equal to five (5) percent of the bid.

GENERAL BIDS:

Shall be submitted to the Awarding Authority, 2nd floor, 26 Court Street, Boston, MA 02108 before twelve o € clock noon (Boston time) on Friday, May 2, 2008, at which time and place respective bids will be opened and read aloud. Late bids will not be accepted.

General contractors must file with their bids (1) a copy of a valid Certificate of Eligibility (DCAM Form CQ7) showing that they are eligible to bid on projects in General Building Construction, up to a project amount and up to an aggregate limit, and (2) with a completed and signed Update Statement (DCAM Form CQ3) summarizing the contractor € s record for the period between the latest DCAM certification and the date the contractor submits its bid.

General Bids must be accompanied by a bid deposit in the form of a certified check drawn on, or a treasurer € s or cashier € s check issued by, a responsible bank or trust company, payable to the City of Boston, or a bid bond of a surety company qualified to do business in Massachusetts and satisfactory in form to the Awarding Authority. The amount of such check and penal sum of such bond shall be a sum equal to five (5) percent of the bid.

CORI CLEARANCE REQUIREMENTS:

In accordance with state law (M.G.L. c.71, s.38R, as most recent amended by Chapter 385 of the Acts of 2002), the Boston Public Schools may request and obtain all available criminal offender record information (CORI) from the Criminal History Systems Board of any contractor € who may have direct and unmonitored contact with children. €

As a condition of the award of any contract pursuant to this Invitation for Bids, and prior to commencement of any work, successful contractors agree to complete and sign a Request Form to obtain CORI if, in the determination of the Office of Facilities Management (the Awarding Authority), some or all of the individuals employed by the Contractor € may have direct and unmonitored contact with children € during the performance of their work on school property.

The Awarding Authority € s determination will be based on whether or not the Contractor € s personnel would or might be working in areas within the school in close, unmonitored proximity to students. The above requirements shall apply equally to filed sub-bidders (if any) nominated by the apparent low bidder.

OSHA TRAINING REQUIREMENT:

Bidders for construction contracts regulated by M.G.L. c.30 and M.G.L. c.149 are reminded of the OSHA training requirement for all employees established by Chapter 306 of the Acts of 2004. By submitting a general bid or sub-bid, contractors certify that all employees to be employed in the work have completed a ten (10) hour course in construction safety and health approved by the United States Occupational Safety and Health Administration.

Chapter 306 mandates that documentation of successful completion of said OSHA course must be submitted with the first certified payroll report for each employee to be employed at the worksite. Failure to submit such documentation will result in the denial of payment(s) owing for services rendered until the above documentation is satisfied.

The attention of all bidders is specifically directed to the equal employment opportunity section of the specifications and the obligation of the contractor and all subcontractors to take affirmative action in connection with employment practices throughout the work.

Contractors are hereby notified that the work covered by this contract is governed by M.G.L. c. 149, sections 26 to 27G, and in accordance therewith contractors must pay prevailing wages as established by the Massachusetts Department of Labor and Workforce Development/Division of Occupational Safety.

A performance bond, and also a labor and materials payment bond, of a surety company qualified to do business under the laws of the Commonwealth and included in the U.S. Treasury € s current list of approved sureties (Circular 570) and satisfactory in form to the Awarding Authority, and each in the sum of 100 percent of the contract price, will be required of the successful bidder to guarantee the faithful performance of the contract.

The Awarding Authority reserves the right to waive any minor informalities or to reject any and all bids, or any part or parts thereof, and to award a contract as the Award Authority deems to be in the best interest of the City of Boston and the Boston Public Schools.

The award of any contract shall be subject to the approval of the Superintendent of Schools and the Mayor of Boston.
