The Colorado Procurement Code provides that a contract may be awarded for a supply or service, without competition, when there is only one source for the required supply or service. Therefore, a "sole source" procurement is justified if there is only one item or service that can reasonably meet the state's need and there is only one vendor who can provide the item or service.

The Colorado Department of Corrections is considering the purchase of a medication dispensing system that the Department believes could greatly mitigate its waste of unused, packaged medications. The primary component of the system is a dispensing machine that would be located at each correctional facility clinic. The machine would securely hold virtually all commonly prescribed medications in bulk containers. When a particular inmate patient arrived and scanned his/her ID, the inmate's identity would be transmitted to the dispensing machine, which would access the inmate's Electronic Medical Record for his/her current prescription(s), which the machine would then dispense in a daily dosage and seal in a plastic bag to be given to the patient.
The Department knows of only one firm, Talyst, Inc. (talyst.com) that is capable of providing such a dispensing system. The Department intends to enter into a pilot agreement with Talyst to evaluate and determine the efficacy of the Talyst dispensing system with approximately six machines to be placed in various locations. If the Department determines that the system works well, and the savings in the cost of prescription medication waste merit doing so, the Department will proceed with a longer term, full scale implementation.
The ensuing agreement between the Department and Talyst is expected to be in the form of a purchase order or State contract for a direct lease rental, with no obligation or option to purchase and no obligation to the State beyond the current 12-month fiscal year period.
