| Opportunity Summary |
In accordance with Oregon Revised Statutes (ORS) 279B.075 and Oregon Administrative Rule
(ORS) 125-247-0275, the State of Oregon, Department of Administrative Services (herein
after "DAS"), intends to issue a contract to IBM (Contractor) for CIMS conversion to IBM's
Tivoli Usage and Accounting Manager (ITUAM) product.
Background:
The State Data Center presently maintains a large installation base of CIMS product,
originally purchased under a competitive solicitation in 2003 (RFP #10700052-03). On
January 25, 2006, IBM acquired CIMS Lab Incorporated and as part of the acquisition, IBM
began administering the CIMS contract. At that time, CIMS Lab became a wholly-owned
subsidiary of IBM.
IBM has now fully absorbed the funds of CIMS Lab with intent to migrate all of its
customers to IBM standard agreements. Additionally, IBM has upgraded, modified and
improved the existing CIMS product, and has renamed this product IBM Tivoli ITUAM and IBM
Tivoli Decision Support (mainframe).
The State Data Center requires use of the ITUAM and Tivoli Decision Support products to
further expand the existing base and provide increased functionality. These products
enable billing of usage amounts to customers and therefore are critical to the funding and
support of the State Data Center.
The ITUAM and Tivoli Decision Support products are available exclusively from IBM direct
and are not offered through resellers.
DAS has conducted research required by ORS 279B.075, which provides that the efficient
utilization of existing goods require the acquisition of compatible goods or services from
only one source. Pursuant to ORS 279B.075(2)(d), other findings that support the
conclusion that the goods or services are available from only one source.
The determination on which this Sole Source is based is located under contract number
4021. Per OAR 125-247-0275(3), an Affected Person may protest the determination that the
Supplies and Services are available from only one source in accordance with OAR 125-247-
0710.
Written protests must include:
a) A detailed statement of the legal and factual grounds for the protest;
b) A description of the resulting harm to the Affected Person; and
c) The relief requested.
Written protests must also reference the Sole Source Notice Number SS-169-08, must be
signed by an authorized representative, and must be delivered in hard copy or faxed to the
following address or fax number by April 1, 2008 at 2:00 p.m. E-mailed protests will not
be accepted.
